LJCP recommends legislation against girls abuse
ISLAMABAD: The Law and Justice Commission of Pakistan (LJCP) has recommended amendment in laws for strict sentences against the judgments of Panchayats and Jirgas whereby young girls are abused in exchange for heinous crimes to settle the local disputes, Geo News reported.
The Law and Justice Commission of Pakistan met with Chief Justice Iftikhar Mohammed Chaudhry in chair today. The meeting also recommended cancellation of Federal Court Act 1937.
The chief justices of high courts of four provinces also attended the meeting besides the attorney general of Pakistan, secretary law and others.
Addressing the meeting, Chudhry Iftikhar urged for the need of legislation in Pakistani law for the benefit of poor masses, adding that the prevailing laws have to be revisited in line with the changing needs of our society.
The Commission on Friday took serious note of the prevailing practice of exchange of women and young girls in the marriage as a “Badal-i-Sulha” on the intervention of Jirga and Punchaiyat to settle local disputes.
The Commission directed Law & Justice Commission Secretariat to suggest amendments in the relevant law so that stringent action should be taken against all those involved in such heinous crime against women.The meeting was held under the chairmanship of Justice Iftikhar Muhammad Chaudhry, Chief Justice of Pakistan/Chairman Law & Justice Commission of Pakistan.
The Chairman commission in his remarks said that there was need for legislation on issues related to public importance and bringing the existing ones in accordance with the changing requirements of society. He stressed for simplification of laws for easy comprehension and removing inconsistencies in such legislation.
He said that legislation should be made after due process as provided in the Constitution. He said: “The system of administration of justice revolves around the provisions of Constitution which provide safeguards for fundamental rights of the citizens; therefore, it is incumbent upon all the institutions to adhere to the provisions of Constitution in discharging their functions.”
The Commission also recommended amendment in the National Judicial (Policy Making) Committee Ordinance 2002 for including the Chief Justice of Islamabad High Court as member of the Committee.
It examined Law Reform Proposals for amendments in the Law and Justice Commission of Pakistan Ordinance, 1979 and recommended amendments for including the Chief Justice of Islamabad High Court as member of the Commission, empowering the Commission to sign MoUs with the foreign Law Commissions for conducting research and insertion of provision to allocate funds for the Provincial Judicial Academies from the Access to Justice Development Fund.
It approved the rules for regulating the functions of District Legal Empowerment Committees constituted under the Access to Justice Development Fund (AJDF) to provide legal aid to the deserving litigants who were unable to obtain legal aid or assistance for protecting their genuine legal rights or interests, involved in litigation, on account of limited financial resources.
The Commission also approved accounts and expenditure of Access to Justice Development Fund The Commission also examined the proposal for Repeal of Federal Court Act, 1937 and after deliberations recommended that the enactment being redundant might be repealed.
