BANGALORE: The fate of 11 disqualified BJP rebel MLAs will be decided on Friday as the High Court will pronounce its judgment on the issue.
Justice Sabhahit, who was appointed as the third judge to adjudicate the issue, heard the matter at length for two days and reserved the judgement for October 22, after the division bench gave a split verdict on October 18.
The verdict of the third judge will possibly give a new political dimension to the state politics. The ruling and opposition parties are eagerly waiting for this verdict as the future of B S Yeddyurappa government depends on it.
In view of the judgement, High Court security has been beefed up and the city police has decided to deploy more number of policemen, said a police personnel in the High Court security.
The division bench differed on para 2(1)(a) of the Tenth Schedule of the Constitution which deals with disqualification of members who leave a party voluntarily.
With regard to malafide action of the Speaker and violation of rules with regard to issuance of showcause notice, the division bench had arrived at a consensus. The third judge deals with the issue pertaining to para 2(1)(a) of the Tenth Schedule which has to decide whether inferences can be drawn against the 11 BJP MLAs who voluntarily withdrew their support to the BJP government on October 6, by giving a letter to the Governor.
Senior counsels B V Acharya, Ravivarama Kumar and K G Raghavan appeared on behalf of the 11 BJP MLAs. For Yeddyurappa, senior counsel and former attorney general of India Soli Sorabjee and senior counsel Satyapal Jain appeared.
