Karnataka HC bench differs on disqualification of 11 MLAs






NEW DELHI: The Karnataka High Court two-judge bench on Monday differed on disqualification of 11 BJP MLAs by Speaker K G Bopaiah

The issue will now go to another bench. 

On the disqualification of 5 Independent MLAs, the two-judge bench agreed that it should be heard by "some other bench". 

The issue of 11 BJP MLAs will now come up before a third judge on Oct 20. 

Chief Justice Khehar Singh upheld the Speaker's order but Justice N Kumar rejected it. The judges agreed on three points but on the point of Anti-Defection Law, they disagreed. They agreed that the Speaker followed the rule of natural justice and had no malafide intention. 

They were also of the same view that rules were followed by the Speaker, but they disagreed on the point of the applicability of the Anti-Defection Law in the disqualification of 11 MLAs. 
Earlier on Thursday, Karnataka chief minister B S Yeddyurappa expectedly won a vote of confidence in the truncated state Assembly, a victory which will depend on the High Court's decision on the disqualification of 16 MLAs. (times of india)
