Pak SC averts clash with govt over court appointments

ISLAMBAD: In a continuing war of wills between Pakistan's judiciary and the parliament , the supreme court on Thursday directed parliament to reconsider a constitutional amendment dealing with procedures for appointing judges to the higher courts. But it did not strike the amendments down. 

Analysts saw the court decision as a middle ground in the current atmosphere of mutual suspicion and acrimony between the judiciary and the executive. Several petitioners had demanded striking down the constitutional amendments. 

The ruling came in response to legal challenges to a set of amendments to the constitution approved by parliament in April. 

The constitutional changes were hailed as a historic step in empowering parliament because they revoked unfettered powers accumulated by the country's past military dictators. 

But the amendment that dealt with appointment of judges to higher courts was considered controversial. 

The chief justice, Iftikhar Muhammad Chaudhry, did not want parliament to have a veto and preferred that he have final authority on the appointments. (the times of india)
