2G scam: Excerpts from the affidavit

New Delhi:  An affidavit on behalf of Prime Minister Manmohan Singh was filed in the Supreme Court today which rejected the charge of inaction on the part of his office in dealing with the request of sanction for prosecution of former Telecom Minister A Raja in the 2G spectrum issue.

In an 11-page affidavit, filed through Director, PMO, V Vidyawati, it was stated that there was no inaction on the part of the PMO on the complaint filed by Janata Party President Subramanian Swamy seeking the sanction for prosecution of Raja. 

Here are a few excerpts:

I'm making this affidavit only for the purpose of showing how the various letters received from the petitioner have been duly considered.

On 1.12.2008, the PM perused the letter (Swamy's letter) and noted "Please examine and let me know the facts of this case." This was marked to the Principal Secretary to the PM who in turn marked it to the Secretary. The Secretary marked it to me as Director in the PMO. 

It is specifically mentioned in paragraph 2 of the letter dated 31.10.2009 of Shri Swamy that an FIR was registered by the CBI and "the substance of the allegation made by me in the above cited letters to you are already under investigation." 

On 9.02.2010, I prepared another note placing on record the advice from the Department of Legal Affairs. I stated that according to the advice, the decision of granting sanction for prosecution may be determined only after perusal of the evidence collected by the investigating agency, the CBI and other materials to be provided to the competent authority.  (ndtv)

Affidavit confirms all my issues on 2G spectrum: Swamy

Janata Party chief Subramaniam Swamy on Saturday said the affidavit filed on behalf of Prime Minister Manmohan Singh in the Supreme Court confirms all issues he had raised on the 2G spectrum allocation and claimed he was now free to approach a lower court to seek prosecution of former Telecom Minister A Raja.
Swamy also called for immediate cancellation of licenses issued through undervalued sale of 2G spectrum.
"I am satisfied that the affidavit filed on behalf of Prime Minister Manmohan Singh confirms all my issues with facts. I am happy with the response," he told reporters here.
Now, he said, he was free to file a complaint before a session judge and ask a warrant be issued against Raja, who quit as Telecom Minister last week for his alleged role in the spectrum allocation.
Swamy said the Prime Minister replied only to one of the five letters he sent on the 2G spectrum issue.
This (sale of 2G spectrum) is the biggest scam of the world which cost to the government exchequer by Rs 1.76 lakh crore. So, all licenses must be cancelled immediately and a fresh auction must be held in this regard," he said.
Swamy said he has also written a letter to Singh urging him to put Raja under a high level security cover. "I think, a jail could be a secured place for Raja," he added.
He said he has also urged the Prime Minister to ask the US to share bank transfer records regarding the 2G spectrum deal which it maintains through its communication facility "as this data are vital for future prosecution and finding out the bribe money trail."

Describing Singh as "Bhishma", who mutely witnessed the sins carried out by Kauravas, Swamy said he was not directly involved in the scam and so he will not press for the Prime Minister's resignation.
Though the Prime Minister took two years to respond to his letters, Swamy said Singh was not responsible for the scam "because he is an economist and did not study law."
When asked as to what objection he has against Attorney General G E Vahanvati, Swamy said he would not mind if Vahanvati represents Prime Minister in the court.
"But if he appears for giving arguments in the 2G spectrum deal on behalf of the government, I would object because he is the man who advised Raja for not sending the matter to group of ministers and cabinet for necessary approval," he added.
He also claimed that a whopping Rs 60,000 cr were paid as bribe in the undervalued sale of 2G spectrum.  (indian expess)
