CARLSBAD — One little girl grew up with a part of her life that was different than other girls, although she did not know it at the time.

A male relative would periodically ask her to undress and would inspect her genital area to make sure she was "clean."

The routine did not begin to feel wrong until she got older, when the man gave her objects and he showed her how to masturbate so she would not have to go out with boys.

When she did start going out, he began acting out simulated rape scenes with the girl, where he would force her to the ground and rip her clothes off — once choking her with his belt.

This was the story told to the jury by Chief Deputy District Attorney D'Ann Read during a trial at district Court Friday.

"He put his belt around her neck and choked her to show her what it's like to be raped," Read said. "It is impossible for most people to understand the nightmare she was going through."

43-year-old Francisco D. Sarabia of Carlsbad was found guilty of two counts of criminal sexual penetration of a minor, six counts of criminal sexual contact with a minor, and two counts of child abuse for alleged incidents involving a young female relative.

Defense attorney James Klipstine said it sometimes seems like too hard a task to be a juror.

"This is a hard case, as a parent as a human being," he said. "Our immediate response is to say 'lets do anything we can to help her. But you can't. That's the reason it's so hard — you



can't."

He alleged the girl made up the charges after she got in trouble.

"She had plenty of opportunity to talk to people, but didn't," he said. "What changed was she got caught going out and her parents threatened to move her to Arizona. And when the princess doesn't get her way "

Read said the allegations by girl split up her family.

"(The victim) has noting to gain," she said. "Everything else, she's already lost."

The alleged abuse surfaced when the girl went to the doctor for a medical examination, where she checked a box on a form next to a question that asked if she felt she had been treated badly by a romantic partner or someone else, and then checked another box asking about physical or sexual abuse. When asked about it by a physician's assistant, she reluctantly told him about the Sarabia's inspections, a criminal complaint filed in the case stated.

The girl told police about an alleged incident in December of 2008 when she was 16. She Sarabia wanted to inspect her, and she became upset because he had already promised her he would never do it again.

"'Promise me you won't do it again' — this was the cry of (the victim)," Read said. "But he would do it again."

She told police after she went out on a date with a boy that night, she returned and Sarabia noticed she had on different underwear than she had before. She said he checked her again to make sure she was still a virgin, the complaint stated. This time, she said, it hurt.

Klipstine showed the jury receipts from purchases made that night, saying the times on them made her story impossible.

Further, Klipstine said the medical examination of the girl revealed she was penetrated more times than she had alleged.

"This is a case that is riddled with questions," he said.

The girl's mother told detectives Sarabia was alone with the girl for long periods of time in her bedroom with the door closed. She also said Sarabia was a skilled liar.

"I gave them my opinion," she said.

She testified that she declined to prosecute Sarabia.

Klipstine argued the mother and brother of the alleged victim declined to prosecute because she lived in the same home with the girl and knew the allegations were not true.

Read told the jury the girl endured hours on the witness stand during the trial and two preliminary hearings.

"(The victim) could have backed down" she said. "She is here before you because she is seeking justice."
